RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AND PARENTAL CONSENT AGREEMENT ("AGREEMENT") IN CONSIDERATION of being permitted to participate in any way in the ATHLETES LAB PERFORMANCE CENTER facility activities ("Activity") I, for myself for personal representatives, assigns, heirs, and next of kin: ACKNOWLEDGE, agree, and represent that I understand the nature of such activities and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the Activity. FULLY UNDERSTAND THAT: (a) ATHLETES LAB PERFORMANCE CENTER ACTIVITIES INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH ("RISKS"); (b) these Risks and dangers may be caused by my own actions or inaction’s, the actions or inaction’s of others participating in the Activity, the condition in which the Activity takes place, or THE NEGLIGENCE OF THE "RELEASEES" NAMED BELOW; (c) there may be OTHER RISK AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation or that of the minor in the Activity. HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE ATHLETES LAB PERFORMANCE CENTER, their respective administrators, directors, agents, officers, members, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owner and lessors of premises on which the Activity takes place, (each considered one of the "RELEASEES" herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE "RELEASEES" OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim against any of the Releasees, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claim. I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT. MINOR RELEASE AND I, THE MINOR’S PARENT AND/OR LEGAL GUARDIAN, UNDERSTAND THE NATURE OF ATHLETES LAB PERFORMANCE CENTER ACTIVITIES AND THE MINOR’S EXPERIENCE AND CAPABILITIES AND BELIEVE THE MINOR TO BE QUALIFIED, IN GOOD HEALTH, AND IN PROPER PHYSICAL CONDITION TO PARTICIPATE IN SUCH ACTIVITY. I HEREBY RELEASE, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS EACH OF THE RELEASEE’S FROM ALL LIABILITY CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON THE MINOR’S ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE "RELEASEES" OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATION AND FURTHER AGREE THAT IF, DESPITE THIS RELEASE, I, THE MINOR, OR ANYONE ON THE MINOR’S BEHALF MAKES A CLAIM AGAINST ANY OF THE RELEASEES NAMED ABOVE, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS LIABILITY, DAMAGE, OR COST ANY MAY INCUR AS THE RESULT OF ANY SUCH CLAIM. CANCELLATION POLICY I also understand that ATHLETES LAB PERFORMANCE CENTER does enforce a cancellation policy. You need to have at least 24 hours notification of cancellation to get a full refund on all ATHLETES LAB PERFORMANCE CENTER SERVICES. If you do not give 24 hour notice, fees will be collected for these services at full rate. You will be refunded completely if given over 24 hour notice. PRIVACY POLICY ATHLETES LAB PERFORMANCE CENTER which uses eSoft Planner for scheduling and taking payments, is committed to protecting your privacy and ensuring you have a positive experience on our website. This policy outlines our handling practices of personal information both online and offline data. If you give us personal information, we will treat it according to this policy. If you are not satisfied with our response to your privacy-related concerns, please contact us. We encourage you to read this privacy policy to ensure you understand eSoft Planner's privacy practices. This policy covers the eSoft Planner website and related software. Collection of your personal information When ATHLETES LAB PERFORMANCE CENTER and eSoft Planner collects any personal information on our website, we will express our need for the personal data at the point of collection. We encourage you to review the privacy policies posted Waiver of Liability and Assumption of Risk Relating to Coronavirus/COVID-19 The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death. ATHLETES LAB, LLC cannot prevent you, your child(ren), or your family or those you come into contact with from becoming exposed to, contracting, or spreading COVID-19 while utilizing ATHLETES LAB, LLC’s services or premises. It is not possible to prevent against the presence of the disease. Therefore, if you choose to utilize or participate in ATHLETES LAB, LLC’s services, programs, individual or team events, or enter onto ATHLETES LAB, LLC’s premises (hereinafter the “Activity or Activities”) you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19. IN CONSIDERATION of being permitted to participate in ATHLETES LAB, LLC’s Activities and to use and BE ON PREMISES of ATHLETES LAB, LLC, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, I hereby covenant and agree as follows: ASSUMPTION OF RISK: I acknowledge and fully assume the risk of illness or death related to COVID-19 arising from my being on the premises and participating in the Activities. The Activities and premises are of such value to me and to my children, that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize ATHLETES LAB, LLC’s services and premises in person. WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suit against ATHLETES LAB, LLC and its owners, officers, directors, managers, officials, trustees, agents, employees, assigns or other representatives in connection with exposure, infection, or spread of COVID-19 related to the Activities and utilizing ATHLETES LAB, LLC’s services and premises. I understand and agree that the law of the State of North Carolina will apply to this Agreement. TERM & APPLICATION: I acknowledge and understand that the circumstances regarding COVID-19 are changing from day to day and that, accordingly, CDC and other guidelines are regularly modified and updated and I accept full responsibility for familiarizing myself with the most recent updates. By executing this Waiver Agreement, I intend for it and its terms to apply to my participation in any and all Activities and presence on ATHLETES LAB, LLC’s premises at all times, whether now or in the future, without re-execution or execution of another Waiver Agreement. I understand this waiver means I give up my right to bring any claims including for personal injuries, death, disease, property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen. In the event that any provision of this Waiver Agreement is held to be void or unenforceable, all other provisions shall remain unaffected and be enforceable. It is my express intent that this Waiver and Hold Harmless Agreement shall bind any assigns and representatives, and shall be deemed as a RELEASE, WAIVER, DISCHARGE, AND COVENANT NOT TO SUE. I ACKNOWLEDGE THAT THIS WAIVER WAS EXPRESSLY NEGOTIATED AND IS A MATERIAL INDUCEMENT THE PERMISSION GRANTED BY ATHLETES LAB, LLC TO BE ON PREMISES AND PARTICIPATE IN THE ACTIVITIES. I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THIS RELEASE, AND FREELY AND KNOWINGLY ASSUME THE RISK AND WAIVE MY RIGHTS CONCERNING LIABILITY AS DESCRIBED ABOVE:
